An FBI agent shot and killed a kidnapping victim Thursday in Houston, Texas - a victim the FBI appears to have been trying to rescue.

The men took Valladares to Cunningham's girlfriend's house in northeast Houston, court records indicate. The kidnapping victim was fatally injured and pronounced dead at LBJ Hospital.

Police in Conroe, about 40 miles north of Houston, confirmed the man had been kidnapped and held for ransom.

The incident began when two men with handguns forced their way into a residence while a 12-year-old boy and his father were home.

The 12-year-old son is in CPS custody and hasn't been told about his father's death. When Villadares answered the door, the men pushed their in with guns, according to investigators.

Meanwhile, an uncle arrived at the house and got a phone call from a man demanding money in exchange for Valladares' return, police said. The child said he heard the two men say the boy's uncle, who was not home at that time, owed them money.




Investigators say the kidnappers claimed to be part of a drug cartel and made ransom demands before they were captured. Authorities expect to charge Perez Heath with one count of aggravated kidnapping, according to the Chronicle.

His last arrest in 2004 resulted in an aggravated robbery conviction. Two men and one woman are charged with aggravated kidnapping.

"The system failed", Conroe Police Chief Philip Dupuis said during a news conference Thursday. It is unclear how or why at this time.

The FBI went to that home, where Villadares was found bound with tape. The FBI says two children were inside the home when the man was killed. "During the course of the operation, an individual was fatally injured", reads a statement from the Federal Bureau of Investigation.

The agent who shot Valladares has been placed on paid administrative leave pending the outcome of the investigation. The FBI's Evidence Response Team is on scene. [.] The FBI takes very seriously any shooting incidents involving our agents and as such have an effective, time-tested process for addressing them.

"In the interest of protecting the investigation's integrity, we can not comment regarding investigative details", she said in an emailed statement. She declined to provide details of the shooting, citing an ongoing investigation.
