Gov. Greitens was indicted on Thursday on a felony charge of invasion of privacy.

The alleged offense happened before a January 1, 2017 change to the criminal code (a D felony is now up to seven years), so the max prison time Greitens faces is four years in the Department of Corrections.

Greitens who is married, was having an affair with his hair dresser and while she was partially nude he allegedly took a photo of her in a place where she had an expectation of privacy.

The charge stems from allegations that Greitens used a photo of his naked mistress as a form of blackmail to keep her quiet about their affair.

A judge said Greitens could be released on his own personal recognizance and is allowed to travel, according to Susan Ryan, a spokeswoman for the St. Louis Circuit Attorney's Office.
