  • Judge Blocks New Pro-Life Mississippi Law Banning Abortions After 15 Weeks

The Republican governor of MS is criticizing a federal judge's decision to temporarily block a state law banning abortion after 15 weeks, the most restrictive abortion law in the United States.

Not only is banning abortions at 15 weeks unconstitutional, it's also a breach of a woman's right of choice.

U.S. District Judge Carlton Reeves granted a temporary restraining order on Tuesday, just one day after Gov. Phil Bryant signed the controversial law.

"The Supreme Court says every woman has a constitutional right to "personal privacy" regarding her body", Reeves wrote in a brief decision that quoted previous legal rulings on abortion.

'We are saving more of the unborn than any state in America, and what better thing can we do?' Bryant said in a video his office posted on social media.

Today he tweeted-I pray today we have saved the first life of an unborn child in Mississippi. However, she cautioned that law changes alone would not protect women. The law does not make exceptions in cases of rape or incest.

Reeves stated in court that the "ultimate question" is whether a state can ban abortion before viability. Opponents and supporters of abortion rights both recognize this new law for what it is: part of a longer-term effort to ban abortion entirely. It reinstituted and expanded the "Mexico City" policy, which forbids funding of worldwide aid programs that "perform or promote" abortion. The state and the clinic must now provide "expedited briefings" to the court while it considers issuing a preliminary injunction.

Mississippi, the state with the highest infant mortality rate and worst overall ranking in the nation for children and infant care, according to a recent report, is expected to adopt the country's strictest abortion laws on Monday. Current federal law does not.

There are only two exceptions to the ban: if an unborn child has health problems that would make him or her "incompatible with life" outside of the womb at full term, or if a pregnant woman's life or a "major bodily function" is threatened by continuing the pregnancy. His state, effective immediately, now holds the distinction of having the earliest abortion ban in the nation.

When it comes to determining the practicality of abortion, the deadline always has to do with fetal viability.

For women living in poverty who need time to gather resources to pay for an abortion and for those outside Jackson who need to find ways to cover additional expenses associated with travel, House Bill 1510 will close the door to a procedure that's been a legal right for women since the passage of Roe v. Wade in 1973. Many Black women in MS don't have access to private health insurance that covers comprehensive reproductive health care and the state does not provide Medicaid funding for abortions. Whatever challenges we have to take on to do that, is something we're willing to do'.

MS law had previously prohibited abortions after 20 weeks. It also asked the court to block the ban, a particularly urgent request because a woman was scheduled to have a 15-week abortion Tuesday afternoon.
