By a 6-0 vote today, March 29, the Court of Appeals ruled the depiction was "nothing more than cultural comment", according to Reuters.




But on Thursday, New York's top court ruled that the characters didn't actually look like her.

This was the other character Lohan was upset with. Not only did Lohan's 2013 defamation lawsuit fail, her lawyers were caught plagiarizing. Lohan claimed he defamed her by rapping "So, I'm tip-toein', to keep flowin', I got it locked up, like Lindsay Lohan".

British-American model and journalist Shelby Welinder came forward before the ruling revealing that she was the person used for the bikini woman and even had a payslip from Rockstar Games to prove they employed her.

Despite the dismissal of Lohan's appeal, the case may have some lasting ramifications.

In a separate order, the court dismissed similar claims against Take-Two by Karen Gravano, a star of the reality TV series "Mob Wives", over another character.
