A NY judge has set May 24 for the next court appearance by President Donald Trump's personal lawyer, Michael Cohen, as he fights to limit what criminal prosecutors can see from raids on his home and office.

Investigators are now probing whether Cohen committed bank fraud when he paid adult film star Stormy Daniels $130,000 from his home equity line of credit in exchange for her silence on an alleged affair with Trump. "But depending on dollars involved, which can be a big driver, or if they look at him and say it's not two to four years, it's 18 to 22, then how loyal is he?" said one defense lawyer who represents a senior Trump aide in Mueller's Russian Federation investigation.

"To quote the court, there are gaping holes in the application by Mr. Cohen and Mr. Trump to delay this matter", said Michael Avenatti, Daniels' attorney.

Over the years, Mr. Trump threatened to fire Mr. Cohen over deals that didn't work out, or snafus with business projects, people who were present for the discussions said.

Trump's moods have grown darker in recent days, as he lashes out at the "overreach" of the raid.

He explained that he does not see the same legal "vulnerability" for Trump in Special Counsel Robert Mueller's probe.




"There's a significant level of cooperation between us and the Southern District of NY U.S. attorney's office", he added.

Indeed, Avenatti is now alleging that he has evidence of bank fraud involving Michael Cohen, which he has nearly certainly shared with the F.B.I.

On Twitter Sunday, Trump said that all lawyers are now "deflated and concerned" by the Federal Bureau of Investigation raid on Cohen, adding that "Attorney Client privilege is now a thing of the past". But he believes the true smoking gun is a so-called Suspicious Activities Report (S.A.R.) reportedly created by the Treasury Department earlier this year after a bank is reported to have flagged Cohen's account for dubious transactions. Avenatti said that Trump thinks that he is above the law.

Trump is reportedly anxious about the charges that Cohen could potentially be hit with and whether his lawyer will flip.

Cohen famously said he would take a bullet for Trump, but that's an easy thing to say as a hypothetical. Those around Trump have hoped that this week's visit to Mar-a-Lago, where he is generally happier, along with the tightly scheduled summit with Abe, would somewhat distract him from Cohen and from Comey's ongoing publicity tour.

The White House and a spokesperson for Melania Trump have denied the affair. One recent presidential dinner guest was Hannity.
