  • Venkaiah Naidu rejects opposition's impeachment motion against CJI

Eminent jurists like Soli Sorabjee and Fali Nariman and some ex-judges did not find fault with today's decision of Rajya Sabha Chairman M Venkaiah Naidu rejecting the impeachment notice against Chief Justice of India Dipak Misra but there was a political divide among lawyers associated with various parties on the outcome.

Informed sources said that Naidu was not happy with the way the opposition parties had straightway gone to the media after submitting their impeachment motion to him. Sibal said the Congress will move a petition in the Supreme Court challenging this order. "And that's why we have left it to his (CJI) conscience", he added, reports IANS.

"What was the tearing hurry?" But if there was even the slightest suspicion, it became the duty of Parliament to take note of that, he said.

"Obviously there was some tearing hurry. I don't think momentous matters such as these should be dealt with in such a hurried fashion".

"It is our privilege to move the motion".

The Congress, which led the opposition bid to impeach the Chief Justice, had however said that it will move the Supreme Court if the Vice President rejected the impeachment motion. But Congress allegations of less than fair play must be set against the motion's merit or lack of it. "I have applied my mind to all five charges made out in impeachment motion and examined all annexed documents".

The order destroys the legitimate processes of the law. He said that the party is going to accept whatever decision the court takes. "This will jeopardise the judicial system", he concluded.

"Naidu cited a Supreme Court order to reiterate that the CJI, as Master of Roster, was entitled to allocate cases as he deemed fit and referred it as an internal matter of the judiciary". "So, this is likely to be rejected", the Minister of State for Parliamentary Affairs said.

"No conspiracy can be proved by direct evidence". It sinks the bar for a measure that requires utmost circumspection, maximum consensus and unimpeachable evidence.

Justice Dhingra, too, supported Naidu's order on impeachment and said, "Rejection was absolutely right and based on facts". "How do you verify something without an inquiry". This is a very serious matter and we can't allow the cancer of corruption to grow. Maybe they have information that the CBI has information, maybe by scuttling the inquiry they don't want a lot of information to come on record.

In a separate tweet, Surjewala wrote, "Within hours of 64 MP's submitting the impeachment motion, Leader of Rajya Sabha (FM) had expressed naked prejudice by calling it a "revenge petition" virtually dictating the verdict to Rajya Sabha Chairman on that day. I will not get into the reasons (which everybody knows), but I will say that this is a part of a larger trend to demonise and weaken every institution that seeks to maintain its individual identity and not kowtow to the dynasty", Shah said in a blog.
