"I'm not going to stop the execution of the search warrant", Sacramento Superior Court Judge Michael Sweet said, saying gathing DNA evidence, photographs and fingerprints is routine when a suspect is booked.

Joseph James DeAngelo, 72, has been arrested by police investigating the Golden State Killer deaths.

Thus far, DeAngelo - a former police officer and Navy sailor who trained in San Diego - has been charged in connection with eight murders.

"While the database was created for genealogical research, it is important that GEDmatch participants understand the possible uses of their DNA, including information of relatives that have committed crimes or were victims of crimes", he said.

It's been one week since DeAngelo was arrested at his Citrus Heights home for the crimes of the East Area Rapist.

DeAngelo was arrested final week and recognized because the suspect in no less than a dozen murders and greater than 50 rapes between 1976 and 1986.

Howard filed the motion to block efforts by the district attorney to take DNA, fingerprints and photos of DeAngelo's body.




DeAngelo has yet to enter a plea in the case.

Neighbors have said DeAngelo mostly kept to himself and sometimes yelled at people who got too close to his fence, but they said he had become a recluse in recent years.

It was unclear when prosecutors will collect the new evidence. On Sunday, the US government will open nationwide enrollment for an ambitious experiment: If they can build a large enough database comparing the genetics, lifestyles and environments of people from all walks of life, researchers hope to learn why some escape illness and others don't, and better customize ways to prevent and treat disease.

"In the present case, obtaining the defendant's major case prints and his DNA sample does not require him to speak or say even a word", deputy district attorneys Thienvu Ho and Amy Holliday wrote in a filing obtained by the Bee.

DeAngelo is scheduled to return to court May 14.
