Giuliani says Trump doesn't intend to pardon himself, but 'probably' can

  • NYT Trump lawyers make case in memo to Mueller

For Trump, the presidential pardon holds a special resonance, representing one area where he has nearly unchecked power as other aspects of his presidency - especially special counsel Robert Mueller's ongoing probe into Russian interference in the 2016 presidential election - remain outside his control.

It was believed to be the first time Trump himself has asserted the power, although his lawyers have taken an expansive views of the president's prerogatives, including the right to pardon.

Special counsel Robert Mueller's investigators are trying "very, very hard to frame" President Trump in the "highly partisan" Russian Federation probe, Trump attorney Rudy Giuliani charged Wednesday in Israel.

"Thankfully, the President has not done anything wrong and wouldn't have any need for a pardon", White House Press Secretary Sarah Sanders told reporters. He then again decried special counsel Robert Mueller's probe as a "never ending Witch Hunt". The president's lawyers fear an interview could lead to Trump inadvertently, and they say innocently, committing perjury. "Despite that, we play the game because I, unlike the Democrats, have done nothing wrong!"

Trump's legal team is making clear that it will combat any effort to force the president to testify in front of a grand jury.

Giuliani is leading the defense of Trump in special counsel Robert Mueller's investigation into whether Trump associates coordinated with Russian Federation during the 2016 presidential election, and whether Trump took steps to shut down that investigation through actions, including the firing of FBI Director James Comey.

Giuliani has been vocal and aggressive in his defense of Trump on cable news airwaves since Trump appointed him in April as part of his legal defense team.

"It is pointing out that the president is the stronger figure", Giuliani said.

The pardon for Johnson could come as early as Tuesday, and the paperwork was being finalized Tuesday morning, according to a person familiar with the discussions.

After Speaker of the House Paul Ryan (R-Wisc.) responded to President Donald Trump's claim that he can pardon himself, he shot down the "spygate" story that's been pushed by the president on Twitter. He said the informant was used to investigate Russia's role in the election. "He's got to have the discipline to put a stop to it, or we're going to have to do everything we can, including some things that I don't think we'd want to talk about right now, to try to, to try to appeal to have it stopped", he said. "But look, if they can convince us that it will be brief, it would be to the point, there were five or six points they have to clarify, and with that, we can get this - this long nightmare for the - for the American public over". "It violates constitutional prohibitions on self-dealing, and if you use the pardon power to eviscerate checks on the presidency, that's also an abuse of the pardon power", Gillian Metzger, a constitutional-law scholar at Columbia University told the daily.

The office recently informed 180 petitioners that they would not be granted clemency at this time, a White House official confirmed to CNN, but the administration has said it will continue to review pardons and make decisions on a rolling basis. I don't know where the President would go forward pardoning himself.
