State AG Ferguson to file lawsuit over 3D-printed guns

  • Access To 3-D Printable Guns Blocked In Pennsylvania

The multistate lawsuit alleges that the settlement between Wilson, his company and the Trump administration did not get the approval of the Department of Defense, and didn't give Congress 30 days notice before agreeing to allow Defense Distributed to begin publishing 3D-gun files, by creating a special exemption for Wilson's company in the ITAR.

It means anyone with a 3D printer - which costs around $2,000 and can be programmed to build objects of nearly any shape - will be able starting next week to make plastic-bodied guns at home for just a few hundred dollars each.

"The harm to Pennsylvanians would have been immediate and irreversible", Shapiro said in a statement.

The guns produced on 3D printers are made nearly entirely out of ABS plastic, the same material used to make Lego bricks.

"If a person has a printed gun that is made of the right materials they will be undetectable and everyone sitting on an airplane will be put at risk", Durkan said. That same day Wilson and the Second Amendment Foundation filed a preemptive suit against New Jersey Attorney General Gurbir S. Grewal and L.A. City Attorney Michael Feuer, claiming the alleged intents of both men portend a violation of Wilson's First Amendment rights via "unconstitutional prior restraint". "By Sunday, 1,000 people had already downloaded 3D plans for AR-15 semi-automatic assault rifles".

Defense Distributed in 2013 was stopped from posting the online gun plans by the State Department. Wilson posted the plans for his gun, called the Liberator, onto his website, where the plans were downloaded thousands of times. Per Reuters, the government argued as recently as April of this year that 3D printable guns would fall into the hands of criminal groups and extremists. Until June 29, the federal government had maintained that the printer files and tutorials violated firearms export laws.

The 3D-printed guns files are slated to be uploaded on DEFCAD.com this Wednesday. The Commonwealth applied for a temporary restraining order and preliminary and permanent injunction to prevent Defense Distributed from making any 3D printable firearms available over the Internet.

The complaint is not yet available to the public but Ferguson's office says the Second Amendment Foundation and Defense Distributed will be named in the lawsuit as "necessary parties".

The Trump administration is being sued for allowing plans for 3D-printed guns to be published online.

Neither the company nor its owner, Cody Wilson, responded to requests for comment Monday. "Defense Distributed was promising to distribute guns in Pennsylvania in reckless disregard of the state laws that apply to gun sales and purchases in our Commonwealth". "Without any checking, because all you do is go online, buy the kit, and you can make it".
