California lawmakers pass nations toughest net neutrality law

It's expected that numerous largest ISP will file lawsuits, while California has also technically violated nationwide FCC rules put in place under current chairman Ajit Pai that say states can't make their own net neutrality laws.

California is one of almost three dozen states weighing net neutrality rules after the Federal Communications Commission voted a year ago to reverse the rules. It would bar providers from collecting new fees from apps and sites as a condition of reaching internet users.

California's legislation restores net neutrality regulations first imposed by the Federal Communications Commission in 2015, during the Obama administration. On Wednesday, the State Assembly passed a bill-the first of its kind in the USA -that would require such companies to change that.

The legislation primarily prohibits plans that exempt the same type of content from some companies over others - video streamed on YouTube but not Hulu, for example. A California law could have nationwide implications, since internet service providers are loath to operate under multiple sets of rules. In some of its provisions, the California bill goes further than the national rules that the FCC repealed, taking an expansive view of the broadband industry's public obligations. Ajit Pai, the FCC chairman appointed by President Donald Trump, pitched the repeal as a way to stop the federal government from "micromanaging the internet".




Now that it has passed the California State Assembly, SB822 moves on to the State Senate where it should have no difficulty passing. They are sponsored by Common Sense Kids Action and have support from the Consumer Federation of America, Electronic Frontier Foundation and Privacy Rights Clearinghouse, among others. Opponents of net neutrality have long said they favor less regulation. The rules prevented internet companies from exercising more control over what people watch and see on the internet.

Eshoo mentioned, as a reason new rules are needed, Verizon's recent throttling of internet data for Santa Clara County firefighters as they fought the Mendocino Complex fire, the largest in California history.

The Assembly's vote followed months of intense lobbying from internet companies, which warned that it would lead to higher costs.

Senate Bill 822 heads back to the state Senate, which must look at amendments introduced to the bill after senators endorsed it in May. "And they're not going to let their elected officials get away with it if they sell out their constituents by siding with big telecom companies".
